league resignation
« on: September 08, 2012, 10:55:51 AM »
I tried to look at the usbc site for the rulebook but I get error 404. Maybe someone here knows the answer. In your letter of resignation, can it be stated that the reason for leaving is a disagreement with the corporation that owns the center and how it runs the center? The host center told us they were going to change the pattern every month during the season. One week in, corporate tells the manager he cannot do this. Easiest house shot available is all that is allowed. This morning I learn they fired one of the few employees that actually has a brain and is good for their business. He was running the proshop as well as being an assistant manager. I can see no reason to financially support these morons any longer. Any thoughts here?

I interpret your posting to state the LEAGUE wishes to resign from the Center. Is that true? You have the whole LEAGUE ready to resign from the Center? I find it difficult to believe that the whole League came to an agreement. I've been in leagues for a long time and don't remember when all teams agreed to anything! :P

ON EDIT: Perhaps I misread your posting .. it is only you that is resigning! My error!

Just pay the two weeks due and leave, simple as that.
USBC cannot come after you that....

Years ago I was in a couples league that didn't feel that the bowling center was treating us fairly......poor service, poor lane maintenance and not enough value for the dollar.
So at the year end banquet this was all brought up.
Next season the whole league up and moved across town to another center that greeted us with open arms.
This was a 12 team league bowling every other week during the regular season.
That 1st center could never understand why the league left.
free agency it is until i get a better offer.   LMAO

Are the lane conditions they put out spelled out in the contract you signed with the house.  If not, you're hosed.  Then it becomes hearsay and not grounds to break your contract.  If it is in writing that they would change the shot every month, you can leave them for breach of contract.
Long Gone also posts the honest truth which is why i respect him. He posts these things knowing some may not like it.

It's just me and a few others wanting to walk out. There was no contract regarding conditions. The manager was just trying to do the right thing for the bowlers and corp won't let him. The whole thing is a bunch of BS from a failing company.

I have read more negative feedback about AMF centers on here than any other owners. I was wondering how long it would take before one of you figured it out. The local manager here is great. AMF won't let him run his center. If they would just leave him alone.

If you relied on the representation that the shot would be changed to join or rejoin, you can claim fraud in the inducement. One can not fraudulently induce or trick you into entering into a contract and the insist on performance despite their material misrepresentations.

The operator may be a good guy, but he joined the league officials to represent that the shot would be changed. They had a duty to know. Stated differently, they knew or should have known that they could not do what they promised.  They also knew or should have known the limit of their authority.

Either way, I would not be forced into staying or paying if they misrepresented things to get me to join.

By the way, I have bowled for only 4 years. However, I do not recall ever signing  a contract to join the league.  By paying the USBC fee and signing the card, that is likely the basis of the relationship. I have not read the card  but I am guessing it says I agree to USBC  rules.

That agreement would not be a defense to your claim that you were fraudulently induced to join that particular league. In fact, I would guess that there is a USBC rule prohibiting this type of misconduct.

Whether the USBC person addressing this particular issue for you  (if it gets that far) will have walk and tie my shoe sense is a different question.

Individual league bowlers don't sign contracts, but the representative(s) of leagues (ie. secretary, president) sign a contract with the center. It's their agreement on lineage rates, length of league, etc.
