hawkeye4life: TAKING LEGAL ACTION
« on: November 16, 2006, 08:18:34 AM »
Here is what I got from PayPal today:

quote:
After careful review, we have concluded our investigation of the Buyer
Complaint described below.

We have decided in your favor, however, we were unable to recover any
funds
from the seller's account. As stated in the PayPal User Agreement,
recovery
of funds associated with a Buyer Complaint cannot be guaranteed.

Please know that we will make our best effort to recover the funds in
question if they become available in the seller's account in the future
and
will take appropriate action against the seller. Such action may
include
issuing a warning, a temporary restriction, or terminating the account.
Keep in mind that PayPal uses a number of factors to determine when to
take
action, including member complaints. Due to privacy laws, we cannot
discuss
the details of any action taken. We hope you understand our policy and
that
it assures you that you are safe using PayPal.

Adam has obviously scammed all of us by delaying our action with this stunt that he KNEW would not cost him a thing. I have already dug up most of his personal information thanks to a buddy of mine who works in private investigation, so I am going to report him to his local authorities and to the Internet Fraud department. Anyone wishing to join me in this action pleast post here and we will get organized.

**ADAM: YOU HAVE UNTIL 10 P.M. TONIGHT TO RESPOND TO ME**

This ends now.

we payed him with our credit card thru paypal
why can't he do the same,he got 3 balls from allstar
when he should be paying us back.

If you used a Visa, Master Card, ect. that's a true credit card not a debit card, then call the credit card company and file a complaint, they will do a charge back to Paypal. I have had to do this in the past, it is the easiest to go about it.

I got the same message and I'm out 75 bucks.  Is anyone heading up getting ahold of the authorities?

Strapper,

Not gonna work.. when everyone signs up to use paypal it is clearly stated what they are and are not responsible for. Its in all the fine print/small writing most people never read..

If the seller has a zero balance in his paypal account (which I guarantee most he does), there will be NO refund via Paypal.

That email they send out stating they rule in your favor but cannot issue a refund is BS, but thats the dnager of dealing with paypal and dishonest sellers..

I agree with you that paypal has the bank account number and do not understand why they cannot withdraw the funds from the sellers bank account when they rip people off.. I really do dislike using paypal but its a neccessary evil sometimes..

JK

quote:
I've had it happen as well with paypal.  Anyone a lawyer?  Is it / would it be possible to bring a class action suit against paypal for everyone who has received that B.S. message from them stating that they have ruled in our favor, but were unable to recover funds (even though they are linked to the users bank account and a credit card)?

just a thought...

You know.. I was thinking the same thing a few days ago when I read the ASB feedback for him stating that he purchased several balls...  if he didn't have any money to payback everyone.. why was he buying equipment.. then I thought maybe he was going through alternate channels to get everyone their equipment...  Yeah right!

I'm hoping for the best for all of you that were scammed...

I filed my complaint with Paypal on November 10th, so it hasn't been ten days yet for me. I sent Adam an email a couple of days ago mentioning that I filed the complaint "as he requested" and that I haven't seen any futher progress. He responded stating that it usually takes 10 to 30 days.

I'm not sure exactly what that means, but it doesn't sound good, if you guys are getting emails from Paypal saying they can't do anything...

Right now, I'm out $75.

Guys all he does is get a couple of good transactions with paypal.  Then gets his friends to vouch for him.  Put some real tasty deals out there and when all the money gets in he closes his bank account.  It's called fraud and with all the people he's ripped off it will be a felony.

I agree 100% with that. Its not that hard to do..

Paypal should be held liable in someway, but they wash their hands of most problems..

I've had good deals with him until now. He has been around for a while, didn't expect this from an older member.

Pulze,

just go back and read all the posts on this issue. There are 4 or 5 of them floating around here. The bottom line is user hawkeye4life has received alot of money from mutiple users here and not delivered the balls as promised so people are very upset as some have waiting 3-4 weeks and nothing but excuses from the seller..

I agree with all of you who got ripped off.He should be prosecuted.
As to why PayPal can't remove the funds from his bank account,FDIC laws which govern 99% of financial institutions in this country don't allow anyone other than you or the bank where you have your account to remove funds.
I checked into this with an officer at the bank I use and that's what I was told.
I hope this helps explain why PayPal can't simply give you your money straight from his account, but it's in no way a defense of this idiot.

I would think the best solution to this would be for Adam to accept reimbursement through money orders to the parties involved. Forget PayPal.

Worst case, he fails to meet demands, and is reported to local authorities as well as the Internet Crime Complaint Center.

I want to say give him some time, but he can't show his face here to update anyone on the status or respond to PM's, so it's time to drop the hammer.

http://www.ic3.gov/

On the complaint form, they ask the following:

quote:
Are there witnesses or other victims to this crime?
If yes, Please provide names, addresses, phone numbers, email addresses, and/or websites of where additional victim lists can be found.

I think those of us who are owed money should collaborate on this particular field and fill it in with the appropriate information.

Okay guys, Update:

I just called Adam's HOME PHONE which is his PARENTS HOUSE. I feel this is how we will be getting somewhere. I spoke to his little brother, Tyler, who was home sick from school. Tyler said that Adam won't be home until Sunday, but Tyler is going to do his best to contact Adam and tell him that he's in trouble. I'm going to call back tonight and speak with Adam's parents. Hopefully they can get something done about this.

We will DEFINITELY be getting our money back, folks.

I would definitely suggest filing an internet fraud complaint.  It alerts the local authorities of the problems (many times in my experience this has been enough to convince the offenders to make good).  If not, its on their record and any time down the road they slip-up, you are set.  I recently received a call from a DA's office somewhere in Colorado about an ebay fraud complaint I had filed four years ago!  They arrested the person for something else and when checked, they found my complaint as well.  The lady in the office told me that while the person was in court, they would also bring up other offenses (including mine) and pending the outcome, I may receive reimbursement.  So truely, you never know.

As far as paypal, I have started paying (whenever at all possible) with a credit card instead of directly pulling the funds from my account.  My hope is that if something like this happens to me in the future, I could reply on the credit card company to recover my funds (as we know paypal is severly lacking in this area).

UPDATE:

Adam called me from his cell phone confirming the story that he will be back on Sunday. He has agreed to OVERNIGHT me a Money Order on Monday with a tracking #. He wants me to relay to everyone that he is sorry and that he is going to be getting everyone refunds over the next week or two.

Adam was honest with me that he did not have enough money available to him to pay everyone back what he owes them immediately, but he will be doing so over the next little while. He will be home and available next week, from what he told me, so I think, slowly but surely, this situation will be resolved.

Either way, I won't believe him until I see results.
