Title: hawkeye4life: TAKING LEGAL ACTION
Post by: BrooklynSlop on November 16, 2006, 08:18:34 AM
Here is what I got from PayPal today:

quote:
After careful review, we have concluded our investigation of the Buyer
Complaint described below.

We have decided in your favor, however, we were unable to recover any
funds
from the seller's account. As stated in the PayPal User Agreement,
recovery
of funds associated with a Buyer Complaint cannot be guaranteed.

Please know that we will make our best effort to recover the funds in
question if they become available in the seller's account in the future
and
will take appropriate action against the seller. Such action may
include
issuing a warning, a temporary restriction, or terminating the account.
Keep in mind that PayPal uses a number of factors to determine when to
take
action, including member complaints. Due to privacy laws, we cannot
discuss
the details of any action taken. We hope you understand our policy and
that
it assures you that you are safe using PayPal.

Adam has obviously scammed all of us by delaying our action with this stunt that he KNEW would not cost him a thing. I have already dug up most of his personal information thanks to a buddy of mine who works in private investigation, so I am going to report him to his local authorities and to the Internet Fraud department. Anyone wishing to join me in this action pleast post here and we will get organized.

**ADAM: YOU HAVE UNTIL 10 P.M. TONIGHT TO RESPOND TO ME**

This ends now.

I would also appreciate it if some of you could spread the word of this to the other bowling forums that Adam is a member of: bowlingkindom.com, bowlingballexchange.com, etc... I don't want anyone else getting ripped off by this loser.

Slop,

I had the same thing happen to me with that jeffseniorpba guy a year or so ago. He is the guy that ripped off mutiple people here. He stole $85 from me. Paypal ruled in my favor but they are absolutely no help at all in recovering the funds.. I received that same BS email you received. It makes no sense to me. Paypal has the bank account info from that person so why can't they take the money out of their bank account and pay people back the refund that they are owed??

I still use paypal but they for sure have major issues when it comes to buyers recovering funds.. Thats for sure..

It's nice that Paypal sends the message that users are...
"SAFE!".

It's nice to know that!  Even if someone has your money and you got the shaft!

That sucks!

Sorry for all you guys!

Paypal is a joke, that is why to this day I don't have a paypal account.  I've been an ebay member since 1998.  If it's a paypal auction only, too bad you lost my bid.

Good luck to you guys!!

So where's the hawkeye cheerleading squad now?

I've had it happen as well with paypal.  Anyone a lawyer?  Is it / would it be possible to bring a class action suit against paypal for everyone who has received that B.S. message from them stating that they have ruled in our favor, but were unable to recover funds (even though they are linked to the users bank account and a credit card)?

just a thought...

You know.. I was thinking the same thing a few days ago when I read the ASB feedback for him stating that he purchased several balls...  if he didn't have any money to payback everyone.. why was he buying equipment.. then I thought maybe he was going through alternate channels to get everyone their equipment...  Yeah right!

I'm hoping for the best for all of you that were scammed...

If you used a Visa, Master Card, ect. that's a true credit card not a debit card, then call the credit card company and file a complaint, they will do a charge back to Paypal. I have had to do this in the past, it is the easiest to go about it.

Strapper,

Not gonna work.. when everyone signs up to use paypal it is clearly stated what they are and are not responsible for. Its in all the fine print/small writing most people never read..

If the seller has a zero balance in his paypal account (which I guarantee most he does), there will be NO refund via Paypal.

That email they send out stating they rule in your favor but cannot issue a refund is BS, but thats the dnager of dealing with paypal and dishonest sellers..

I agree with you that paypal has the bank account number and do not understand why they cannot withdraw the funds from the sellers bank account when they rip people off.. I really do dislike using paypal but its a neccessary evil sometimes..

I filed my complaint with Paypal on November 10th, so it hasn't been ten days yet for me. I sent Adam an email a couple of days ago mentioning that I filed the complaint "as he requested" and that I haven't seen any futher progress. He responded stating that it usually takes 10 to 30 days.

I'm not sure exactly what that means, but it doesn't sound good, if you guys are getting emails from Paypal saying they can't do anything...

Right now, I'm out $75.

Guys all he does is get a couple of good transactions with paypal.  Then gets his friends to vouch for him.  Put some real tasty deals out there and when all the money gets in he closes his bank account.  It's called fraud and with all the people he's ripped off it will be a felony.
Title: Re: hawkeye4life: TAKING LEGAL ACTION

I agree 100% with that. Its not that hard to do..

Paypal should be held liable in someway, but they wash their hands of most problems..

Pulze,

just go back and read all the posts on this issue. There are 4 or 5 of them floating around here. The bottom line is user hawkeye4life has received alot of money from mutiple users here and not delivered the balls as promised so people are very upset as some have waiting 3-4 weeks and nothing but excuses from the seller..

I agree with all of you who got ripped off.He should be prosecuted.
As to why PayPal can't remove the funds from his bank account,FDIC laws which govern 99% of financial institutions in this country don't allow anyone other than you or the bank where you have your account to remove funds.
I checked into this with an officer at the bank I use and that's what I was told.
I hope this helps explain why PayPal can't simply give you your money straight from his account, but it's in no way a defense of this idiot.

I would think the best solution to this would be for Adam to accept reimbursement through money orders to the parties involved. Forget PayPal.

Worst case, he fails to meet demands, and is reported to local authorities as well as the Internet Crime Complaint Center.

I want to say give him some time, but he can't show his face here to update anyone on the status or respond to PM's, so it's time to drop the hammer.

http://www.ic3.gov/

On the complaint form, they ask the following:

quote:
Are there witnesses or other victims to this crime?
If yes, Please provide names, addresses, phone numbers, email addresses, and/or websites of where additional victim lists can be found.

I think those of us who are owed money should collaborate on this particular field and fill it in with the appropriate information.

Okay guys, Update:

I just called Adam's HOME PHONE which is his PARENTS HOUSE. I feel this is how we will be getting somewhere. I spoke to his little brother, Tyler, who was home sick from school. Tyler said that Adam won't be home until Sunday, but Tyler is going to do his best to contact Adam and tell him that he's in trouble. I'm going to call back tonight and speak with Adam's parents. Hopefully they can get something done about this.

We will DEFINITELY be getting our money back, folks.

I would definitely suggest filing an internet fraud complaint.  It alerts the local authorities of the problems (many times in my experience this has been enough to convince the offenders to make good).  If not, its on their record and any time down the road they slip-up, you are set.  I recently received a call from a DA's office somewhere in Colorado about an ebay fraud complaint I had filed four years ago!  They arrested the person for something else and when checked, they found my complaint as well.  The lady in the office told me that while the person was in court, they would also bring up other offenses (including mine) and pending the outcome, I may receive reimbursement.  So truely, you never know.

As far as paypal, I have started paying (whenever at all possible) with a credit card instead of directly pulling the funds from my account.  My hope is that if something like this happens to me in the future, I could reply on the credit card company to recover my funds (as we know paypal is severly lacking in this area).

UPDATE:

Adam called me from his cell phone confirming the story that he will be back on Sunday. He has agreed to OVERNIGHT me a Money Order on Monday with a tracking #. He wants me to relay to everyone that he is sorry and that he is going to be getting everyone refunds over the next week or two.

Adam was honest with me that he did not have enough money available to him to pay everyone back what he owes them immediately, but he will be doing so over the next little while. He will be home and available next week, from what he told me, so I think, slowly but surely, this situation will be resolved.

Either way, I won't believe him until I see results.

Guys, I've gotten a few PM's asking for his phone number, and I just can't give it out... I hope you understand.

Here's the deal: Send Adam an email to newmanadam@hotmail.com and newmanadam77@yahoo.com with your Name, Address, and the amount he owes you.

He "says" he's going to get everyone a refund and this is probably the best way to do it.

PNJ is totally correct and if I'm not mistaken if he is still a minor in any sense his parents will be responsible for the lost $$$ if legal actions are pushed. I would put in a call to his local law enforcement group and ask about internet fraud laws. I believe if they have enough evidence they can freeze his assets (if not a minor) and possibly give out whatever punishment deemed correct. Adam you have dug a large hole for yourself and excuses are no longer excepted. You have played too long and personally I would go after you legally if i was one of the people out $$. I would hope a lessoned will be learned and for the people out money the longer you wait the more the action is criminal as you are accepting wrongful business tactics as being ok.

Okay, I've been quiet and tried to give Adam every benefit of the doubt, but after reading that he took our money knowlingly to buy his grandma an early Christmas gift, I'm ready to call the police myself.  It's an open and shut case with all the evidence here.  Adam, I either want money sent to me via MO but Tuesday, which means you have tomorrow morning to get it in the mail, or I WILL call your local police station and wherever else that will help with the prosecution.  I'm done working with you.  PM me with tracking number by tomorrow.  Needless to say, you need to borrow money off of your parents to pay everyone back tomorrow or you are going to jail.

No chances Adam.  You made a big mistake that should not go unpunished.  There are a lot of things that could have happened that would have made me want to work with you, but stealing money to buy a gift is not one of them.

For anyone who was taken and used their credit card, try contacting your credit card company. I have had this problem on ebay before and paypal would not help. I contacted my credit card company and was refunded my money. Paypal won't tell you this, because they don't like for the credit card company to get involved. If you used your debit card, you will have to hope he sends you a money order or refund via paypal. Good Luck, hope this will help some.

I agree with jkiser, even though I'm not involved this.  He knew what he was doing from the beginning.  His new balls he listed are brand new releases, No Mercy and the Angular.  He had money to buy them yet keeping hundreds of dollars from you.  Again until he was backed into a corner did he respond. Guys, kill 2 birds with 1 stone, report him and you will still get your money back.  Also let his parents know the whole deal.  Lots of luck to you guys!!!

lane1who is a different member than me. I have had flawless transactions here at BR, and I am well known. I am 15 although, but I am not as dumb as this kid that has about 2000$ worth of fraud on his hands that hes going to jail for.

Shane, like everyone else that has chimed in, I'm not defending any of what's happened, as I'm currently waiting for money back as well. I believe that if I read correctly, Adam said the "new release" equipment that he mentioned was a gift "from" his grandmother. Not that he used the money collected to "buy a gift FOR her"...

if you guys want to know it was an early xmas present from my gma but i am willing to any ball i ahve to someone if they want it instead of a refund

Just a thought, so the record is straight. I'm hoping (just like everyone else) that this gets resolved ASAP!!!

If I owed all this money to people I would take care of that issue FIRST before ordering any equipment regardless who was paying for it..

I haven't gone anywhere.

Why are you bringing me into this?

Adam is my friend. He had no intentions of doing harm to everyone, and he IS doing everything he possibly can to make this right. You act as if he is purposefully trying to scam you.

He has done wrong and is doing his best to correct it.

If you don't like it, do what you have to do.

And we are all adults here. But you act as if you are twelve. And if I was really twelve it makes you such a man to call out a twelve year old [/sarcasm].

Edited on 11/18/2006 11:59 AM

tell me what he has done to correct it. he has not done anything but make up stories and lies. nobody has received a penny of their money. he has admitted it was all a scam. as of right now he is still putting off judgement day. but the end is at hand.

stso i have admitted i was wrong and now i am paying everyone back i am getting a loan so i can pay everyone back soon.  i already have the preaproval.  i understand why you are doing what you are doing i really do i just ask that you hold off on the cops thing because i do have a solution so i can pay everyone back.  i will prove it too once i get the preaproval papers, i know me paying everyone back doesnt make what i did any better but atleast everyeone will get there money back i will even pay people back more that what they paid me if thats what they want i just want to get this taken care of so all of us can move on with our lives.  i know that you guys dont enjoy posting this stuff just as much as i dont enjoy it either but i have to take responsibility and thats what im doing im sorry i didnt get the loan sooner, but when i called paypal they said that they would refund your money and then just make my account negative.  but i guess the never thought to ask if these were ebay transactions or not.  but again i can never say im sorry enough i know that and most of you prolly dont care about me as you shouldnt but i am going to make this right, everyone will get there money back plus some extra if thats what it takes to make them happy.  thank you for your time adam

Since your getting a loan, you should add an extra $10.00 to everyone's refund to make up for all the trouble.  I think that would be fair.

stso, It becomes a different story. I gave Adam the benefit of the doubt with this ordeal, I believe he should be prosecuted at this point, but BENEFIT OF THE DOUBT is what I gave him 1-2 weeks ago, not a "NO MATTER WHAT, I'M BEHIND YOU" card. I believe in giving people second chances, but this is more than enough..Even through this whole dispute, I STILL think you need to shut your god-d-amned mouth and rot in hell.
