Title: UPDATE on Track 3 ball roller deal with user Trackfreak
Post by: jkiser01 on May 28, 2003, 02:33:44 AM
All,

I'm sure most if not all of you know of the problems I had getting this bag, well I got it in the mail today and as I suspected, its not in the condition I ws told by user Trackfreak. I was told it was used for 1/2 the bowling season and then he upgraded to a 4 ball roller, well this bag has been obviously used for several years. Its thread worn on several edges of the bag and scuffed thruout. The shoulder strap is also missing.

I just mailed Trackfreak and told him because he mis-represented the bag, I wanted my full $75 back that I originally paid for a SLIGHTLY used bag, and was gonna be shipping this VERY used bag back to him today via Fed ex ground.

Why can't people just tell the truth about stuff? This has been a nightmare.

Trackfreak, have anything to say? I can provide photos of the bag as I was taking it out of the shipping box just a few minutes ago to anyone that wants to see what this bag looks like. This bag was NOT in the condition you had told me. The edges are worn thread bare in several places. I am VERY angry at this point.

Just sent back my 75 bucks!!

With all the troubles you've been having; I wouldn't send back the bag until you have money in hand...  otherwise you could be right back in the same situation....

Lower Level,

I see your point but I am sick about all of this. How someone can say a bag is "lightly" used and it show up looking like it does, is just amazing. This is a $20-$25 bag at best, not $75 that I paid. I can buy a NEW bag on Ebay for that kind of money.

I have emailed trackfreak to see what he has to say about all of this..

trackfreak,

You are not telling the truth and you know it. I have photos of the bag as it was removed from the box today and it is worn down on both sides of the bottom of the bag and you know it was that way when you shipped it..

I even sent you you a photo of a bag before I agreed to buy it and ask you if it looked like that and you said yes. That picture was of a blue bag and the bag I got from you today is BLACK!! Can you explain that or did you forget saying that? Its also missing the shoulder strap and I specifically ask you if it was included and you said yes. Remember when you told me it was blue? I have that message from you stating it was blue..

Also, michele03, mind your own business. You yourself told me your where trackfreak's buddy, so I'm sure your are siding with him to look good on this post and make me seem like the bad guy. In fact, its kind of funny how you posted 16 minutes right after trackfreak's response on this post and you are new to this board and trackfreak has been having all of these problems with several different buyers. I think maybe trackfreak and michele03 are the same person..

Regardless, let me repeat.. DO NOT DEAL WITH TRACKFREAK. He sold me a bag that was described as new and its far from that and is also misssing a strap and worn as described above..

He will also not make things right on this deal, so I would stay away.. He is actually threatening me saying I am "harrasing him"..

I have a $20 bag and he has my $75 bucks..

If you're referring to Trackfreak I would tend to agree.

It sounds like he misrepresented a product & is now not going to stand behind it like an honest adult would.

Different color, more wear on it than suggested & missing straps, that is enough to warrant a refund in any reasonable persons book.

Then again it Trackfreak has sounded nothing like a reasonable person to this point.

Jkiser, I also was suspecting Trackfreak to be the mysterious Michele03 too. Or at best it's his girlfriend.

Bulldawg300, Bjaardker, John Figueroa, Strider and Can you Rev,

THANKS to all of you who took the time to read about my situation. I agree with all of your comments. Its obviuos to me, Bill Schmitt (aka trackfreak and/or michele03)is not gonna do the right thing and refund my money.

The main thing is this, DO NOT buy anything from him because this bag was mis-represented, period.

I also forgot to mention something. Upon closer inspection of the bag, the ball protector is missing as well. Its the padded part that is in 3 squares that protects all 3 balls while they are in the ball cups.

Like I said, moot point now, but just furthers my case on trackfreak selling me a piece of junk..

JK, just prove that he is a looser and post a pic of the bag so that we can here him make up stories about the pics.  Just make sure you keep this post at the top all the time with his name so that no body can get the GREAT treatment that you have gotten from him.  I hope someone can also track down his ebay user name and make it public so that he can't use that to rip people off to.  It's people like TrackFreak that ruin a great public site to talk and trade with fellow bowlers.

tenpin,

I agree with everything you said and will figure out a way to post the pics tonight so everyone can see the bag.

Thanks for the support as well..

trackfreak,

Come on, why would you send the bag to me without an important piece like the shoulder strap. I ask you if the bag was functional and its not. The ball protectors are also missing. Where are those?

I also would like for you to show me all the emails I sent you, I emailed ONE TIME after the bag was received and thats it.

As far as slander, I am only stating the truth. You might want to look that word up in the dictionary. Also, I'm not the only one that thinks you did the wrong thing.

Regardless, this bag is a piece of junk and you mis-represented the bag to me and I want my money back.

I don't think you can sue someone for posting their opinion of someone else,
I too would be pissed that I got ripped off.. one thing from the other side of the story though.. I have a 3 ball Storm roller that I have had for 4 years and is in great shape... I think I am pretty hard on my bags and it is only a little dirty from dragging thru the mud...wheels worn a little bit, other than that it looks pretty good. this one was supposedly used for 1/2 season so it should be absolutely brand new... another reason to buy NEW.. or at least with pictures.........

JK, I just went through a bad experience on Ebay. I got my product, as described but shipping took over 2 weeks. It was shipped from Washington to Oregon. 350 miles total. Seller never answered any messages. I won't purchase from this seller again.

Most retailers will take an item back if YOU pay for the shipping to return it.

Trackfreak, give him the $#75 back and he pays the shipping to you and writes it off as a bad experience.

Again, JK, I have a shoulder strap off a Storm Streamline 3 ball roller. It is black but if you want it, I will let you have it. Free!

trackfreak-

I am a  pretty tolerant guy and I try to give people the benefit of the doubt.  At one point I even thought maybe jkiser01 was going overboard on all this.

You take forever to send a bag, you lie about having already sent it, you lie about its condition, and to top it all off now you are threatening to sue him.

Athough normally reserved in my judgements you are an idiot.

Buzzhead,

He can't sue me, I have done nothing but state facts here and thats it. He is just trying to scare me into dropping this and its not gonna work.

The bottom line is this. He agreed to sell me a bag that was mis-represented and because of that, I want my money back. I don't think that is slander..

ttforshort,

Thanks for all the comments. Send me a private message about the strap. I will probably take it.

By the way, I agreed to pay all shipping costs to get the bag back to him as long as he agreed to refund my 75 bucks and he said NO!!

I'm trying to work things out like n adult, but he is not willing at all..

Jkiser01,

Sorry to see that you've had to deal with something like this. However, I appreciate you alerting the rest of us about the shady practices of this user. It's too bad we can't all conduct business in a mature way. Some people only care about themselves and what they get out of things. I wish we could all trust one another, but it's obvious that some people cannot be trusted.

Trackfreak,

First of all, if you know anything about the law, and it seems obvious that you don't, you would know that you would be talking about a libel suit, not slander. Second of all, the odds of winning such a case would be nearly impossible since the messages that you are disputing are on a public forum that is protected by law, and that you have suffered no significant injury because of that speech. You would be smart to just refund his money and take the stupid bag back. I don't know if you're an honest seller or not, becuase we've never done business. However, you're making yourself look very bad because of your stance on this transaction and I would doubt if anyone will work with you in the future. If this were siimply a case of buyer's remorse I would be on your side. But everything that I've seen posted makes me believe that you are in the wrong here. Do the right thing and give the man his money back. Then you can take your bag and try to sell it to someone else, someone who accepts the condition that it is in. Is it an invconvenience, yes. But doing so will prove that you are willing to do the right thing and that you may be trusted. It's your reputation on the line.

All,

I took some more closeup photos while I was home for lunch and will post them later on. They clearly show the corners of the bag where its worn and ripped..

Lets see what trackfreak has to say about that..

JK-

sorry to hear about your horrible transaction. I hope no one ever has to go though what you had to do.

as for trackfreak... don't ever become a seller if you aren't willing to accept criticism. also servicing the customer should be your number one priority if you are an online seller. people would cut you some slack if you would just help satisfy the customer. THAT'S WHAT STORES AND SELLERS DO!!!!

so.. the lesson from all of this... if you're just trying to get rid of something, be HONEST!!!!

trackfreak,

Whatever on the padding between the balls. Where's the shoulder strap? I guess it didn't come with one right?

So are you ready to give me my money back yet or are you gonna keep this whole thing going? I told you I would pay to ship the bag back to you, if you agree to refund my 75 bucks..

I am gonna post pics tonight to let everyone see the bag you sold me..

I have had a few people upset at me over the years and each and every time I had offered a refund. It is the only manly thing to do.

I just sold my Storm 3 ball roller bag for about that price and it is in near mint condition...just ask the buyer...Paul where are ya???

Take it from someone who works in a courthouse. The Lawsuit would be thrown out and he would probably be libel for atty fees. And no that is not harassment, It's a business deal gone bad. Any Atty that would touch that with a ten foot pole isn't worth the paper his or her law degree is written on. Just take back the d@mn bag and call it a day.

I highly doubt it was a typo. Beware of this guy.

Its obvious to me trackfreak is not gonna be a MAN and take the bag back as everyone here thinks he should do to save his character, but then again, its obvious he doesn't care about that either..

Just wanted to give everyone an update. Good old trackfreak is still a man with no conscience. He has not contacted me at all so it looks like I'm stuck with the bag. His "friend" michele03 has offered to purchase the bag for $75, so we will see how that all goes. I will post info on that transaction IF it happens.
