Rule Question

In a league with 5 man teams, we have been one bowler short all year and have used a vacancy.  One of our bowlers missed the last two weeks and we found a sub for him, who would like to become the permanent, fifth member of our team starting the next week we bowl.

That week is a position round and our league rules state that "sixth and seventh members must have at least 9 games to bowl a position round...the exception is the first round, sixth and seventh members must be on the roster by the third week of bowling."

This new bowler was not on the roster by the 3rd week and has only 6 games in the league.  But since he would be our fifth bowler, and not the sixth or seventh, should he be able to bowl in the position round?

in this circumstance since the rule specifically says 6th or 7th bowler i would rule that he would be able to bowl. but knowing the intent of the rule i would not be surprised if the league board ruled against that or brought it to a vote and teams ruled against you.

Yes, however, according to Rule 107c, Item 9, a team must be allowed to add players when
its roster is less than the playing strength of the league. For example, if the playing strength is five, teams must be allowed to have at least five members if the team has four of fewer players on the roster. A rule limiting additions or replacements to a team after a certain date may not be enforced if the team does not have the full playing strength on the roster. After the playing strength is reached, the league rule should be enforced, and a team is not allowed to add members to the team. This rule does not apply to absent players.

Uh, what part of the rules' intent is violated by OP's situation?

Surely you aren't arguing the intent of the rule is to avoid teams with 4 members adding a 5th (even if position round is approaching and the 5th has less than 9 games).....?

I am sure some in your league are going to have an issue with it, but the USBC rules override in this case.

Update:

Our captain got the OK from the league secretary, and he was allowed to bowl.  As far as I know, no one complained.  We won 27 points in the postion round and won the quarter and the bowler in question did not bowl spectacularly, but he did exceed his average each game, which did help us win.

So that worked out.
