Maybe Ebonite should sue Storm next.....

It may be a stretch, but one of my favorite all time Track balls was the NRg way back in the mid 90s. Double D won back to back tourneys with it if I remember right as well. I was looking at Storm's newest ball, the Virtual Gravity Nano...with NRG coverstock! Seems to me like Ebonite would have as good of a chance as Storm did by filing a lawsuit over Mission Domination....

 

Thoughts?

I believe that the issue has to do with copyright laws. My understanding is that the 'Domination' name was copyrighted by Storm. Thus, they forced Ebonite to change the new Mission Domination name.

 

However, if other names from either ball company are not copyrighted, the names are open to use.

 

I could be wrong, so don't take this as gosple. This is what was explained to me by a contact in the bowling industry.

Exactly my point. Its just a name, not an exact match to your ball name, etc.

 

How don't we know that Phil C and the Columbia boys didn't patent the NRg name back in the 90's? I say give it right back to them and see what Storm does.

If you remember correctly, Ebonite had the Illusion back about 10 years ago that had the chromocolor cover to it.  Then, about 5-6 years ago, Roto Grip came out with a ball called the Illusion.  EXACT same name.  If I am wrong, please tell me but I think it is true.

You are 100% correct! Ebonite Illusion came out late 02/early 03 and the Roto Illusion came out in 07....hmmm...wonder what Storm/Roto thinks about that? I wonder if any legal barbs were traded then between the two companies and thus why Storm is coming after Ebo now?

 You guys are grasping at straws.  To help you out here is some relevant info about trademark infringement.

The rights to a trademark can be lost through abandonment, improper licensing or assignment, or genericity. A trademark is abandoned when its use is discontinued with an intent not to resume its use. Such intent can be inferred from the circumstances. Moreover, non-use for three consecutive years is prima facie evidence of abandonment. The basic idea is that trademark law only protects marks that are being used, and parties are not entitled to warehouse potentially useful marks. So, for example, a recent case held that the Los Angeles Dodgers had abandoned rights to the Brooklyn Dodgers trademarkMajor League Baseball Properties, Inc. v. Sed Non Olet Denarius, Ltd., 817 F. Supp. 1103 (S.D.N.Y. 1993).

Roto Grip is bringing out the Infinite Theory, and of course Ebonite had the Infinite One. Ebonite should have just "traded" them so ebonite could use Domination and roto could use Infinite. Would have been a done deal
