I just won this auction

Well, the seller will not sell it to me, saying that it was a mistake. Maybe it was, but that's not my fault. Should I pursue this, or just let it go. Not trying to cause any trouble, but the persom immediatly sent me a message saying it was a "mistake" and there was no freakin way he was following thru. I told him, Fine, post me positive feedback, and I'll let it go. He refuused that also. I'm not the type to post negative feedback unless I get screwed over. I didn't get screwed over here, I'm out no money at all.

He's not asking anyone to feel sorry for him.  Rev-O knew it was a mistake and is trying to take advantage.  I could be wrong, but I believe I read he wasn't even throwing 16lb equipment anymore, which if that's the case he just wants to turn around and sell the ball himself.  

This is just like when Primetime Live does the hidden camera stuff where they purposely give out more change than you should get, everyone knows the right thing to do is say they got too much change, but the attitude is "It's not my fault they can't count". And they're right, it's not "their fault", but the right thing to do is the right thing to do.

So what if it was a mistake?  If something is listed in a store for a penny, you get it for a penny, but because this is EBay, it's ok?  No.  Everyone is on EBay to make a quick buck, they also have to accept the concequenses when they make a mistake.

Do I agree with what Rev-o was trying to do?  No.  Is it immoral?  Maybe.  Probably.  But he won the item.

do a little research into contract law

A unilateral mistake is where only one party to a contract is mistaken as to the terms or subject-matter. The courts will uphold such a contract unless it was determined that the non-mistaken party was aware of the mistake and tried to take advantage of the mistake.[34] It is also possible for a contract to be void if there was a mistake in the identity of the contracting party. An example is in Lewis v Avery [35] where Lord Denning MR held that the contract can only be avoided if the plaintiff can show, that at the time of agreement, the plaintiff believed the other party's identity was of vital importance. A mere mistaken belief as to the credibility of the other party is not sufficient.


Rev-O would be the "non-mistaken" party, he was aware of the mistake and tried to take advantage of the situation, which gives the seller the right to cancel the contract.

I've never been in this situation with Ebay before, but plenty of times with retailers. If a retailer has an advertised price for something, and they try and sell it at a higher price, they are obligated to sell it at the advertised price. I don't know if "legally" they have to, but why wouldn't they? I would then call the BB, give them a bad rap, and they would lose plenty of business.

Now I'm not saying that anyone should get something for nothing. I think in this case, you should have given each other positive review and been on your marry way.

In all seriousness, I have no intention of leaving the seller negative feedback, as I have stated numerous times in this thread already. I'm not out anything!!  I just wanted to seller to apologize for his actions/messages he sent me once the auction ended. I did tell him If he left me +feedback, I'd leave him +feedback. ONCE HE REFUSED TO DO SO, I THEN TOLD HIM, I would contact ebay then. It would really help if he told the whole story. Heck, I'd have dropped it last night and never posted this if he'd acted like an adult instead of a 4yr. old. All he had to do was message me saying. "Hey man, I'm soory, but that auction was a mistake." Not "there no way I'm selling you that ball" or whatever it was he said. I contacted ebay, I'll let them deal with it.

Oh, and for whomever said I was gonna turn this around for profit. WRONG!!
I am getting equipment for our league to raffle off at seasons end.

I am not a buisness... look people this is simple. Mr Rev-0 has a decision to make. I don't care either way what his decision is. I just wanted to come into the thread to give my side of the story & give you the actual facts as to what happened. Thats it. He's not getting the ball.

He can either

a. accept the apology i gave to him earlier & move on

or

b. report this to ebay in 10 days & fight with me about it for a month or two. resulting in (worst case senario for me) a strike against my account. i have to have 3 of those within a 6 month period for ebay to even look at my account to take any kind action. (suspensions, whatnot) I have been an ebay member since jan3 2000 with over 1100 positive transactions 2 negative (retaliations) with no strikes on my record ever. in return for that he WILL get negative feedback


thats it..nothing else is at play here. the ball will be sold in 2 days. this was a mistake that i have paid for by having to pay the fees on the auction. rev-0 does not get to benefit from my mistake. sorry.

i figure you're out less than a buck on that auction. quit making it sound like you lost $100 or something.

Mistakes were made.  Situations were handled incorrectly.  Rev_O lost out on an inexpensive Track ball.  No biggie.  Let's, please, move on.
