I just won this auction

Well, the seller will not sell it to me, saying that it was a mistake. Maybe it was, but that's not my fault. Should I pursue this, or just let it go. Not trying to cause any trouble, but the persom immediatly sent me a message saying it was a "mistake" and there was no freakin way he was following thru. I told him, Fine, post me positive feedback, and I'll let it go. He refuused that also. I'm not the type to post negative feedback unless I get screwed over. I didn't get screwed over here, I'm out no money at all.

It was a mistake.  Ask them what they'd REALLY like to get outta the ball and make a decision from there.  After all, it's just a Track ball, nothing special.

Yeah, I understand it's a mistake. I guess what irriated me the most was the sellers attitude in his messages to me.

It depends, if he was nice about it, I'd let it go, if he was a prick, I'd pursue it.  Even though it's a mistake, he put the item up for auction, and through no fault of yours, he is refusing to honor the terms of the deal.  You have every right to that ball.  So IMO, it just depends on how he treated you in the correspondance.

he wasn't polite at all, and in his first post to me stated if i pursue it, it will cause me more harm than good. I'll sleep on it and decide tomorrow.

Well if he has since relisted the auction is in Violation of Ebays agreement and should be reported.

If you're not really all hot and bothered by the seller's crappy and unapologetic attitude, take the high road. Seeking to mete out justice may make you feel temporarily justified, but in the long run, you know you have better things to do with your time and energy.

Sounds to me like he didn't get what he wanted out of it and is trying to re-list it in hopes of geting more cash.  I'd just send a report to E-Bay and notify them of his suspicious behavior and let them deal with it.  After that, forget it and move on.
